PARTICIPANT’S WAIVER AND RELEASE

FOR PURPOSES OF THIS PARTICIPANT’S RELEASE, “PARTICIPANT” MEANS THE UNDERSIGNED INDIVIDUAL. “EVENT” MEANS THE “GALENTINES PILATES X T-MOBILE” AND ALL ACTIVITIES RELATED TO THE SAME, ON FEBRUARY 14TH, 2026 AT THE RETAIL CENTER COMMONLY KNOWN AS DESTIN COMMONS LOCATED IN DESTIN, FLORIDA. IN CONSIDERATION OF THE OPPORTUNITY TO ATTEND AND/OR PARTICIPATE IN THE EVENT, I, THE PARTICIPANT, ACKNOWLEDGE AND AGREE THAT:

Participation in or attendance at the Event involves inherent risks and dangers of accidents, personal and bodily injury (including death) and property loss or damage, and severe social and economic losses. These may result from my own actions or inactions or negligence, as well as the actions or inactions or negligence of others, or the condition of the facilities. Further, there may be other risks not known to me and not reasonably foreseeable at this time. I understand and I have considered and evaluated the nature, scope and extent of the risks involved, and I voluntarily choose to assume all such risks, both known and unknown, even those risks that result from the negligence of the Released Parties (defined below) or others and assume full responsibility for my participation in the Event. I warrant that I am physically and mentally able to fully participate in the Event.

I fully and forever release and discharge DESTIN COMMONS LTD, DESTIN COMMONS PHASE III, LTD., TURNBERRY MARKETING GROUP, LLC, and their successors, assigns, partners, joint ventures and affiliated entities (collectively, the “Released Parties”), from any and all injuries (including death), losses, damages, claims, demands, lawsuits, expenses and any other liability of any kind, of or to me, my property, or any other person, directly or indirectly arising out of, or in connection with, my participation in or attendance at the Event, even if due to the negligence of the Released Parties, to the fullest extent permitted by law.

I acknowledge that the Released Parties have not arranged for nor carry any insurance of any kind for my benefit and that I am solely responsible for obtaining and paying for any health, life, travel, accident, property or other insurance relative to my injuries or any other loss I may sustain while participating in the Event or attending the Event.

In addition, I hereby grant the Released Parties the absolute and irrevocable right and permission to use, re- use, publish and re-publish any photographs, recordings and/or videos taken of me alone or with others at the Event, in whole or in part, individually or in conjunction with other photographs, recordings and/or videos, and in conjunction with any printed matter, or electronic matter, in any and all media now or hereafter known, and for any purpose whatsoever, and to use my name in conjunction therewith if the Released Parties so choose, without any compensation to me whatsoever. I waive any right to inspect or approve the finished product, advertising or printed matter that may be used in connection with such photographs, recordings and/or videos. I hereby release and discharge the Released Parties from any and all claims and demands arising out of or in connection with the use of such photographs, recordings and/or videos including, without limitation, any and all claims for libel or invasion of privacy.

I HAVE READ THIS PARTICIPANT’S RELEASE, FULLY UNDERSTAND AND AGREE TO ITS TERMS, AND UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS BY SIGNING IT. I AM SIGNING THIS PARTICIPANT’S RELEASE FREELY AND VOLUNTARILY, WITHOUT ANY INDUCEMENT OR COERCION.

BY SIGNING THIS PARTICIPANT’S RELEASE, I CERTIFY THAT I AM OVER THE AGE OF MAJORITY (18 YEARS OF AGE OR OLDER IN MOST STATES).
